1. Acceptance of Terms

By accessing and using the services provided by KidsVibe Party ("we," "us," or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.

These Terms of Service apply to all visitors, users, clients, and others who access or use our event organization services, whether attending events, booking services, or interacting with our website and staff.

2. Service Description

KidsVibe Party provides professional children's event organization services, including but not limited to:

• Birthday party planning and execution
• Animator and entertainment services
• Interactive show programs and games
• Event decoration and theming
• Educational and recreational activities for children
• Community event organization and participation

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Booking and Reservations

3.1 Booking Process

All event bookings must be made through our official channels: website contact form, email at [email protected], or phone at +1 204-391-6628. A booking is considered confirmed only after receiving written confirmation from KidsVibe Party and payment of the required deposit.

3.2 Deposits and Payments

A non-refundable deposit of 30% of the total event cost is required to secure your booking. The remaining balance must be paid no later than 7 days before the scheduled event date. Failure to make timely payment may result in cancellation of your booking.

3.3 Pricing

All prices are quoted in Canadian Dollars (CAD) and are subject to applicable taxes. Prices may vary based on event type, duration, number of guests, selected services, and seasonal demand. We reserve the right to adjust pricing with reasonable notice.

4. Cancellation and Refund Policy

4.1 Client Cancellations

Cancellations made by clients are subject to the following terms:

• More than 30 days before event: Full refund minus deposit (30%)
• 15-30 days before event: 50% refund of total cost
• 7-14 days before event: 25% refund of total cost
• Less than 7 days before event: No refund

4.2 Our Cancellations

In the unlikely event that we must cancel your event due to circumstances beyond our control (severe weather, illness, emergency), we will provide a full refund or offer to reschedule at no additional cost.

4.3 Rescheduling

Requests to reschedule an event must be made at least 14 days in advance. One free reschedule is permitted per booking, subject to availability. Additional rescheduling requests may incur administrative fees.

5. Client Responsibilities

When booking our services, you agree to:

• Provide accurate information about the event, including date, time, location, number of guests, and age range of children
• Ensure the event venue is safe, accessible, and suitable for children's activities
• Provide adequate space for activities, performances, and equipment setup
• Inform us of any special requirements, allergies, or health concerns of attending children
• Ensure adult supervision is present throughout the event
• Respect our staff and treat them professionally
• Comply with all applicable laws and regulations

6. Safety and Liability

6.1 Our Commitment

We prioritize child safety and take reasonable precautions to ensure all activities, equipment, and materials meet safety standards. Our staff are trained in child safety and first aid. However, parents and guardians remain responsible for their children's supervision and safety.

6.2 Limitation of Liability

While we maintain comprehensive insurance coverage, KidsVibe Party shall not be held liable for any injuries, accidents, or damages that occur during events beyond those caused by our gross negligence. Parents and guardians assume responsibility for their children's actions and well-being.

6.3 Medical Emergencies

In case of medical emergency, we will immediately contact emergency services and notify the child's parents or guardians. By using our services, you authorize us to seek emergency medical treatment for your child if necessary and if you cannot be reached immediately.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, videos, and software, is the property of KidsVibe Party and protected by copyright laws. Our original entertainment concepts, show scripts, game designs, and creative materials are proprietary intellectual property.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. Photography and videography at our events are permitted for personal use only. Commercial use requires prior written consent.

8. Photography and Media Release

By attending our events, you grant KidsVibe Party permission to photograph and video record the event for promotional purposes, including use on our website, social media, and marketing materials. If you do not wish for your child to be photographed, please notify us in writing before the event.

We respect privacy and will not share personally identifiable information about children without parental consent. Any media shared publicly will focus on the event experience rather than identifying individual children.

9. Behavioral Expectations

We strive to create positive, inclusive environments where all children feel welcome and safe. Bullying, aggressive behavior, discrimination, or any form of harassment will not be tolerated. We reserve the right to remove any child or adult from an event if their behavior poses a risk to others or disrupts the event.

Parents and guardians are expected to support our staff in maintaining appropriate behavior standards. If a participant must be removed due to behavioral issues, no refund will be provided.

10. Force Majeure

KidsVibe Party shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, public health emergencies, labor disputes, or technical failures. In such cases, we will work with you to reschedule or provide appropriate alternatives.

11. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws. Information collected during booking and events is used solely for service delivery, communication, and improvement of our offerings. We do not sell or share personal information with third parties for marketing purposes.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated "Last Modified" date. Continued use of our services after modifications indicates acceptance of the revised terms. We encourage you to review these terms periodically.

For significant changes that may affect existing bookings, we will make reasonable efforts to notify affected clients directly via email.

13. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Manitoba, Canada. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts of Manitoba.

15. Severability

These Terms of Service, together with our Privacy Policy and any written agreements for specific events, constitute the entire agreement between you and KidsVibe Party regarding the use of our services and supersede all prior agreements and understandings.
